Privacy Statement

1. Introduction

1.1. The Asia Pacific Internet Development Trust (APIDT) is an Australian Charities and Not for Profit Commission (ACNC) registered charity that was established to fund internet development initiatives in the Asia Pacific region.  

1.2. APIDT respects your privacy and is committed to protecting your Personal Information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).   

1.3. To support our charitable purpose and activities, APIDT collects and manages Personal Information about individuals who interact with us.  

1.4. This Privacy Statement relates to APIDT and its subsidiaries, namely APIDTT Pty Ltd and APIDT Infrastructure Pty Ltd, collectively referred to as “APIDT”, “we”, “us” or “our”. It explains how we collect, hold, use, disclose and protect Personal Information, and how you may access or correct it.  

1.5. Where lawful and practicable, you may interact with APIDT anonymously or by using a pseudonym. In some circumstances, however, we may need to collect your identity in order to provide our services, comply with legal obligations or effectively carry out our functions and activities. 

2. Personal Information we collect 

2.1. Depending on your interaction with APIDT, we may collect Personal Information including: 

• your name and contact details; 

• your organisation, job title, role and professional details; 

• correspondence and communication with APIDT; 

• meeting, event or program participation details; 

• payment, billing or contractual information (where applicable); 

• technical information such as device, browser, IP address, website usage and analytics data; 

• travel, dietary or accessibility information, where relevant and with consent where required;  

• images, recordings or transcripts from events or meetings, where applicable;  

• identity or verification information required for grants, funding or due diligence; and 

• any other Personal Information you choose to provide.  

2.2. We collect Sensitive Information only where it is reasonably necessary for our functions or activities and you consent, or where its collection is otherwise permitted or required by law. 

3. How we collect Personal Information 

3.1. In most circumstances, we collect Personal Information directly from you, including when you:  

• contact or communicate with us; 

• register for or participate in a meeting, event or program; 

• subscribe to updates or publications, if applicable; 

• apply for, participate in or support a funding arrangement, grant, program, partnership or other opportunity or initiative; 

• enter into a contract or another arrangement with APIDT, or provide services to APIDT; 

• provide identity, eligibility, due diligence or verification information, where required; 

• use or interact with our website or online platforms; or  

• otherwise interact with APIDT.   

3.2. Where we collect Personal Information from third parties, we will do so only where permitted or required by law.  

4. Why we collect Personal Information  

4.1. We collect, hold, use and disclose Personal Information to:  

• deliver and further our charitable purposes, services, programs and activities; 

• administer, assess or support grants, funding arrangements, contracts, partnerships, programs, events and other APIDT initiatives; 

• communicate and manage relationships with stakeholders, partners, advisers, contractors, service providers and participants; 

• respond to inquiries, requests, complaints or feedback; 

• comply with legal, regulatory, accounting, audit, reporting, compliance and governance obligations; 

• monitor, improve and protect APIDT’s services, systems, information, assets, programs, website and operations; and 

• carry out other purposes permitted or required by law, including managing privacy, security and data breach matters.  

4.2. APIDT does not generally use Personal Information for direct marketing. If we do, we will comply with applicable laws and provide you with a way to opt out.  

4.3. If you choose not to provide Personal Information, we may be unable to provide a service, respond to your inquiry, administer a contract or otherwise engage with you.

5. Disclosure of Personal Information, including Overseas Disclosure 

5.1. APIDT may disclose Personal Information to recipients, including those located outside Australia, where it is reasonably necessary to support our charitable purpose and activities, or where permitted or required by law.

5.2. This may include disclosures to:  

• service providers and contractors who assist us in operating APIDT; 

• professional advisers; 

• funding bodies, project or development partners and other organisations involved in delivering our activities; 

• government agencies, regulators, law enforcement agencies or where required or authorised by law; 

• other persons with your consent or otherwise permitted by law.  
   

5.3. Where APIDT discloses Personal Information overseas, APIDT will take reasonable steps to ensure the overseas recipient does not breach the APPs. The countries in which overseas recipients are located vary depending on the relevant activity or service provider and may not always be practicable to identify in advance.  

5.4. APIDT does not sell Personal Information.  

6. Website and cookies 

6.1. Our website may use cookies and similar technologies to improve website functionality, understand website usage and support website security. 

6.2. You may disable cookies through your browser settings, although doing so may affect the functionality of our website.  

7. Third-party websites 

7.1. Our website may contain links to third-party websites. APIDT is not responsible for the privacy practices or content of those websites and encourages you to review their respective privacy policies.  

8. Security and retention 

8.1. APIDT takes reasonable steps to protect Personal Information from misuse, interference and loss, and from unauthorised access, modification or disclosure.  

8.2. APIDT takes reasonable steps to ensure that the Personal Information it collects, uses or discloses is accurate, up to date, complete and relevant, having regard to the purpose for which it is collected or disclosed.  

8.3. We retain Personal Information only for as long as reasonably necessary for our activities, or to comply with our legal and document retention obligations, after which it is securely destroyed or de-identified where appropriate.  

8.4. Where required by law, APIDT will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) of eligible data breaches.  

9. Access and correction 

9.1. You may request access to your Personal Information, or request that inaccurate, out of date, incomplete, irrelevant or misleading Personal Information be corrected. 

9.2. We will respond to your requests in accordance with the Privacy Act 1988 (Cth). Where permitted by the Privacy Act 1988 (Cth), APIDT may refuse access or correction, and may provide written notice of the refusal or reasons for it where required by law.  

10. Privacy complaints 

10.1. If you believe APIDT has not handled your Personal Information in accordance with the Privacy Act 1988 (Cth), or the APPs, please contact us using the details below and by providing sufficient information for us to investigate your complaint. We will acknowledge, investigate and respond to your complaint within a reasonable time.  

10.2. If you are not satisfied with APIDT’s response, you may lodge a complaint with the OAIC.  

11. Automated decision-making 

11.1. APIDT does not currently use Personal Information in automated decision-making that may significantly affect an individual’s rights or interests. If this changes, we will update this Privacy Statement, as required by the Privacy Act 1988 (Cth).  

12. Changes to this Privacy Statement  

12.1. We may update this Privacy Statement as required to reflect changes to practices, technology or legal obligations. The current version will be published on our website.
